Welcome to the Indianapolis Neighborhood Housing Partnership, Inc. website, located at www.inhp.org (the “Website”).  The Website is operated by or for the Indianapolis Neighborhood Housing Partnership, Inc. (“INHP,” “we,” “our,” or “us”).  INHP is a nonprofit organization whose mission is to increase affordable and sustainable housing opportunities for individuals and families and serve as a catalyst for the development and revitalization of neighborhoods. We offer a variety of programs and services, including classroom instruction and financial coaching designed to help you through each step of the home-buying process.

PLEASE READ THESE TERMS OF USE CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES AND OBLIGATIONS.

You may use this Website only if you accept these Terms of Use (the “Agreement”).  Your use of and participation in the services offered at the Website indicate your assent to this Agreement.   Please read the Agreement carefully, and print and save it for future reference.  If you do not agree with the terms and conditions set forth herein, you should exit the Website immediately, and you may not create a My INHP account.

INHP may modify this Agreement from time to time, in its sole discretion, and such modification shall be effective upon posting.  If we modify this Agreement, we will post the changes on this page and will indicate at the top of this page the date that this Agreement was last revised. You agree to be bound by any changes to the Agreement when you use the Website after any such modification is posted.  Please review the Agreement regularly, as it is your responsibility to abide by the current terms at all times.

ELIGIBILITY

Children under the age of thirteen (13) are not authorized to use the Website.  If, in the future, we decide to direct the Website to children under thirteen (13), we will do so in compliance with the Children’s Online Privacy Protection Act of 1998 (15 U.S.C. 6501 et seq.) including, without limitation, obtaining necessary parental consent.

GENERAL USE

The Website allows you to donate to INHP, schedule classes, request information and begin our program.  The Website may be used only for lawful purposes. You agree not to use the Website for any unlawful or prohibited purpose.  Unauthorized use of the Website, including using the Website to harass other users in any way, is strictly prohibited.  Appropriate legal action may be taken for any illegal or unauthorized use of the Website.

Despite the best efforts of INHP to provide accurate information, it is not possible to completely ensure that information on the Website is correct at all times. INHP assumes no responsibility for any incorrect information or inappropriate content or conduct that is posted or occurs on the Website.

DONATIONS

INHP takes great pride in using resources entrusted to us wisely and effectively to make a difference in our community.  We adhere to the Association of Fundraising Professionals’ Donor Bill of Rights and Code of Ethical Principles and Standards.  When you donate to INHP on the Website and confirm that you are a US taxpayer, please save your receipt for income tax purposes.  You must consult your tax advisor to determine the deductibility of your contribution.  For purposes of the Internal Revenue Code, no goods or services were provided to you in consideration for your gift.

You can learn more about INHP’s programs and services by submitting certain information to INHP through the Website.  Please carefully review any instructions or additional terms before completing forms on the Website.  Also, please remember that children under the age of thirteen (13) are not permitted to submit any content to the Website.

You hereby represent and warrant that any and all information you provide to INHP, including but not limited to your date of birth, your identity, and your financial circumstances, is accurate and truthful and that you will update such information as necessary to maintain its accuracy and truthfulness.  You are solely responsible for any and all information you provide to INHP.

Please carefully review our Privacy Policy for more information regarding the way we handle your personal information.  In accordance with our Privacy Policy , INHP reserves the right, at all times, to disclose any information necessary to comply with any applicable law or to protect our rights or the rights of other users of the Website.

GOVERNING LAW AND VENUE

This Agreement and our relationship are governed by the laws of the State of Indiana without regard to the conflicts of law provisions thereof. You hereby irrevocably consent to the exclusive jurisdiction and venue of the federal and state courts located in Marion County, Indiana in all disputes arising out of or relating to the use of the Website and you hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non convenes with respect to, venue and jurisdiction in such courts.   Use of the Website is unauthorized in any jurisdiction that does not give effect to this Agreement, including this paragraph.

INDEPENDENT CONTRACTORS

No joint venture, employment, or other legal relationship exists between you and INHP as a result of this Agreement or your use of the Website.

SEVERABILITY

If any provision of this Agreement is held invalid or unenforceable, then it will be deemed superseded by a valid, enforceable provision that most closely matches the original intent, and the remainder of the Agreement shall continue in effect.

ENTIRE AGREEMENT

This Agreement and the other documents referenced herein form the entire agreement between you and INHP with respect to the Website.  This Agreement supersedes all prior or contemporaneous communications between you and INHP concerning any matters set forth herein.

VALIDITY OF AGREEMENT

A printed version of this Agreement and any notices given in electronic form shall be admissible in judicial or administrative proceedings based on or relating to this Agreement to the same extent and subject to the same conditions as other business documents originally in printed form.

Any communications, notices, requests or demands relating to this Agreement shall be in writing and shall be deemed given when received upon delivery by hand, transmission by facsimile or email (with proof of confirmation of receipt), or mailing by registered or certified mail, addressed as follows:

ASSIGNMENT

This Agreement may not be transferred, delegated or assigned by either party without the prior written consent of the other party, except that INHP may assign and transfer this Agreement (including your personal data) in connection with the transfer or sale of our business or a merger with a third party.  This Agreement shall be binding upon, and shall inure to the benefit of, the successors and assignees of you and INHP.
